Can you get fined if you’re caught speeding by a mobile vehicle activated sign?

May 5th, 2010 | by admin |

The police were there, but there didn’t look to be any cameras about or any laser guns. Some sites on google reckon police stay there so the signs don’t get stolen…

Usually they don’t fine but merely use these to let people know how fast they are going.
Whether you could beat a ticket depends on how accurate the sign’s mechanism is.
It it were hoses across the road for example, that would be very accurate if there was no other traffic.
But radar is extremely inaccurate and easily confused by other lanes, other traffic, spinning fans, etc.
That would be easy to beat. Radar is never supposed to be allowed as primary evidence.

Once they send you the notice you can ask to see copies of the picture.

Evidence number 1 in Speeding Case: Officer Observation.. made a Visual Observation of your Speed.

Evidence number 2 in Speeding Ticket Case: Radar evidence, officer Testifies he "Clocked" you

next question: "When did you calibrate it?" – Answer should be "When i started my shift"

Judge/Prosecutor: "Do you believe this is the vehicle you intended to Stop?"

.. From there, you may present your evidence.

Sometimes, if they dont have Radar in the car, they KNOW you were Speeding, but they write "Careless Driving."
